Absolutely true, although I'm still hoping to see something cool get done with it. I think they can get around the copyright thing if they make it different enough (completely different names, models etc. Maybe even change the story and game play and make a different game entirely), but as you said there's a lot of work to be done and it's very unlikely that they will ever finish it. But even if they don't finish it (or even get close to finishing it) they can always release it to the public as an open source kind of thing and that would be pretty cool.
There are a lot of people working in / interested in working in Unreal Engine so just throwing the project out there, assets and everything, would probably spark and fuel the start of many other projects which could be built on the TP project's base concepts. Maybe some could even collaborate and make something really nice with it that even ARTAKE Games could've never achieved themselves?
I don't know really just some thoughts. Hopefully everything goes just fine and they make a great game with this, or something else entirely.
