I still think there will be some way to emulate Nintendo's servers, i mean, look at what has ppl done with Blizzard ant its Battle.net, it can be done.
If you really want to take on Nintendo's servers, you should first get to make the emulator identify itself as your own Wii.

Mario Kart Wii -> 12 racers at one time, P2P will barely handle it
