why is it then that i can find loads and loads of nes titles that are good on random sites?
Impossible to find legally.. Like some collector's games that are 99.9% likely not to appear on even auction sites except a few times a year. There is no way Nintendo is losing money if these games are downloaded.
the same goes for a few castlevania games.

Yeah, my point emulator is free, paying nothing to Nintendo. Whether Nintendo makes profit or not, piracy will continue. Also, 3rd party companies won't profile from bought Wiis, only their purchased games.

Using console emulators has been ongoing since the 1990's. All of a sudden it's 2010 and now people are thinking it's illegal? Why didn't they speak up when the first emulators came out?

Because some people are retards, like the author who wrote the article at Games Radar outlined in the first post, the people at Destuctoid and and other game blogging sites.
Most people who aren't active in the emulation scene or community and aren't familiar with emulation tend to have the misconception that emulation is illegal. It's amusing that pirates cause emulation to be lumped right into the same group as piracy and is considered illegal to the uninformed general public.
Edit: Someone should post a comment in regards to that article at Games Radar and link to this thread.

They might be making Dolphin look so illegal so they don't Nintendo on their ass if they feel they might be promoting Dolphin by making an article about it.

I bet most wii devs tries their game in Dolphin during development. At least I would

Nintendo probably has their own in-house Wii emulator (and handheld emus) like all other developers, that can read raw image files before they're pressed on disks and play them as if it was a real wii. The wii also has a fully functional GC emulator in it.
Microsoft games including xbox360 games are developed and tested on the pc too, and their XDK developer kit will convert any source code to ppc instruction capable.
The only problematic console I could think of is ps3. The gpu emulation is not an overwhelming task (seeing it's just a 6000 series nvidia chip) but emulating 8 spu, syncing them with hypervisor and cell instructions on any non-custom computer must be near impossible. Seeing as Sony couldn't even make a fully compatible ps2 software emulator (it has all the same issues as the unofficial pcsx2 emulator)

The truth is it's harder to pay for games compared to downloading them.

Well that's what a job is for, and those who like the game should pay for it instead of downloading. If I can't afford something in a store and I shoplift there are repercussions for my actions, just because someone can't afford to pay for something, doesn't mean they are automatically entitled to it via alternate methods other than paying like everyone else does for their games or items. Downloading digital data may not be stealing in the same sense of stealing physical tangible items, but that's money that the developers that create some of these awesome games are losing to those who download for free and never pay for what they are using even if they like it.
