It's not that I'm pissed, it's outrageous that he is expected to pay that much.
Even though distributing copyrighted material is a morally gray area, technically illegal and he was wrong for doing it, he wasn't making a profit off of it and it's ludicrous to expect him to pay such an outrageous amount that they will likely never see from him. The primary focus of these corporations should be to take down the large piracy rings that make a profit off of someone else's hard work, it shouldn't matter so much that Joe Shmoe is excited and decides to share X material with others and not make a profit off of it. They don't have their priorities straight, their focus is aimed at a rather small time operation rather than the big game piracy rings that are actually causing these corporations harm. Even more ironic is that the country Nintendo originated from is a haven for piracy, with counterfeited products being sold right in the open in stores and on the streets.
They haven't lost any sales because of it, and can you honestly say that these people would of bought the game? There isn't a guarantee that they would even if piracy wasn't an option so it doesn't equate to a lost sale as there would have been no sale anyway.
The unfortunate truth is that this kid was stupid by posting receipts and a picture of him, it should already be quite obvious that these corporations keep a close watch on these communities.
Well there's both Nintendo's and the guy's side of the crime. From his side, the crime wasn't as huge as for example rape, but the punishment is much harder, = unfair (In my country rape is like 1-2 years I think, very little)
But then from Nintendo's side, their losses could be huge, since it was pre-release, (If it was after release you can't blame it all on one guy, because many always upload). While the actual loss is impossible to calculate, in general oppinion this definitely caused Nintendo huge economic damage, which he is responsible for alone, and can be held to compensate (But from Nintendo's view this is also unfair, since they won't get much money from a poor guy. So all they can hope for is some nice anti-piracy propaganda)
Something I realized from writing this... most people who pirated from this guy's copy would probably have pirated the game after release anyway (maybe there was a few more but sounds reasonable?) So while the losses to piracy may not be much larger than usual, the difference is that this guy secured all the blame for himself (what a genius)
This might sound a bit lame, but i think that many places pirating is the only option. (Im not saying I am a pirate!)
I live in a small town in Egypt. The possibility of getting Gamecube games for example is very small I got my family to send me my old games from Norway, but because of locally regulated rules i had to pay a fortune at the post office. And like movies as well there is no store in miles radius where you can find a store to buy a movie. The internet is to slow to download so if you want to see any new movie you have to copy from people you know.
I think that pirating is reaching out to a lot of people who are not really potential customers.
I think for the future they need to think of product placement in games as a second option, because like this game if a 100000 people downloaded it they might have lost 100000 customers, but probably 80% of these are not potential customers. If they use product placement and ads in the games they could get money from companies that reach out to 100000 customers they wouldn't get if it wasn't for pirating.

Much easier and legal alternative is to join group which shares real life copies of games with each member to be ripped for personal use. Thus, physical copy always exists, and you can expand the game library (so instead of 8 people having same game, one game is purchased maximum of 1 time). This way we have literally all hundreds of wii and ps2 isodumps. Still working on xbox library but since emulation is buggy, just on soldered modchip for the console.
Not everyone who has vast game library is thief or pirate. Think of a parallel: You have 20 friends, and each member lends 1 music CD to one another. You rip the music for personal use only, not for selling. So for every legal purchase, each member can get potentially back much more by sharing with the community.
And I agree with Johnblunt, some people just have an interest in hoarding games but not playing them. Having full wii library, I also have games like 'my riding stables' and cheerleader games etc. that I'm never going to play. They just exist as a curiosity, but be it as interesting as it may, there is more to life than just games. Don't take this as an insult, but IMO, a person has to be very lonely and isolated to actually complete every single game that wii, ps2 and xbox have to offer.
I also just play maybe 5-7 games actively, often with friends. Games like 'my riding stables' or singstar games etc... I haven't even booted once. If you are casual user, there is no point to have the full library, which fills up space worth roughly 4.8 terabytes. I boot rare games just to test and have feedback for other people if they ask, but it's not that enjoyable. Fact is, there is a lot of crap on the wii as well besides the few gems. A majority of wii games (besides the brilliant ones like zelda, mario, and a core of about 20-30 quality games) are licensed boring trash.
