and i'd like to point out that gbafail has 99,99999% pirates
so ye, ofc they feel bad for some1 who obviously enough wasn't smart enough.


(on a side note, but thats just personal hate against humanity and its stupidity , i just hope he dies like i stated above. a nice awesome death )

ow and incase you didn't realise. piracy IS a touchy subject for me as i hate piracy these days even more then getting kicked in the nuts (cause apparently i wont be needing those any time soon)
not only has it become socially accepted like drugs & sex , it is increasing in rate fast and has gotten to the point of certain games not releasing on certain platforms...or getting multiplatform causing the game to be crap.
that and it brings so much idiocy...

Many people laugh but some wants to set up a charity for him O_o (guilty pirates?!)

In any case I read that he may not actually have to pay anything, since it was an out-of-court settlement which he is not legally obliged to fullfill

Since many sources are faulty on this case, i conclude this sounds kinda likely since who the hell would chose $1.5 million over a trial (IDK Australian law, but doubt they'd give him worse than that. Besides, if he don't get a well-paid job, it wouldn't make a difference if it was even higher since he can't pay anyway)

Well he wasn't just DL... that would only make him a chump.
The fact that he was distributing... regardless of whether he was profiting or not... of course he deserves what he got.

Since it's so unclear what really happened, I'm gonna post what info I picked up and speculate some myself...

-The guy got an out-of-court deal with Nintendo, including the $1500000, but also not being able to talk freely about it (Aka. only Nintendo present their view, and decides what Burt can tell). So the exact term of the deal is basically secret, compensation may not even be binding. (supported by the fact he didn't choose court)

-It appears from GBAtemp that the guy was indeed an active pirate (Conclusion drawn from his 600+ posts and knowledge of what ioses/patches required for different backups to be run, some of the posts I read)
Yet, in the media, the guy is presented as an innocent Nintendo fan who just casually uploaded the game from pressure by his online friends, for proving he got it early. (not mentioning the obvious wii modding required to get the game dumped, and that his online friends was a forum mainly of wii pirates)

So why didn't Nintendo reps reveal him as the experienced pirate and wii modder he is? Burt himself obviously, would benefit from appearing innocent and not knowing what stupid he was doing. But he know what Nintendo knows, so how would he be able to fool the world...? (unless it was all a deal with Nintendo to give the world the image they wanted of course!)

Nintendo obviously wants the largest scare effect possible on pirates/potential pirates. But what benefit did it do to let this guy present himself as stupid-innocent? how is it better than just saying he was heavily into wii piracy?

I think they're aiming primarily on those that doesn't know anything on how to mod/pirate wii, just making them think "woah the guy was hardly into hacking, he was just a clueless guy like me and got problems like that, tempering with Nintendo stuff = bad bad bad never do". And at the same time, they want as little as possible piracy knowledge to get out to the masses (but I have to question what normal people will think; "if this first-time noob pirate got his game between the wii and computer, how is it done exactly?")
