It's an experimental branch that isn't implemented in the official builds yet. You can try building and running it if you want to, but you can't really get any support for it and I'm guessing there still are issues and limitations.

If it's in violation of the GPL, surely some effort has to be put into taking it down? I thought you had to put some effort into defending copyright, as otherwise future violators can cite past violations as fine, and therefore their violation is fine, too. Isn't the copyright of Dolphin left vulnerable in the current situation?
You are confusing trademark law and copyright law! Trademark law has systems in place where if a trademark is not pushed it can become invalid, but copyright does not.
These days, I'm pretty sure many countries have extended copyright to last well beyond the heat-death of the universe. Copyright doesn't just go away.

I don't think so. And at least I don't care. He provides the source, and we can pick everything he has touched within dolphin. We just can't use theĀ oculus rift library as GPL.
Conflicting open source licenses are very dumb in my opinion, so I see why he is ignoring it.

By the way, as long as he doesn't declare which license his Dolphin.exe has, it's not clear if he violates the dolphin license or the oculus rift one, just that he violates one of them.
