Can I Download a Nintendo ROM from the Internet if I Already Own the Authentic Game?

There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet.

I'd appreciate it if a mod/admin would lock this now and if anyone else in the meanwhile would just let this die. Thanks.
The "It's legal to download if you already own it" excuse is just as tired and tried as the delete after 24 hours myth rom sites have posted.

Yes it's illegal to download any copyrighted material regardless of ownership of said material as you would be downloading someone else's copy. The most legal route you can take is making a backup off of an original copy of a game that you own, and even that is questionable according to large corporations and various DMCA laws.

No one needs to know whether you download a game or not, that is the most foolish and common mistake newbies tend to make when posting here. You wouldn't rob a bank and then foolishly admit it to the police immediately after committing the act would you?

Copyright infringement isn't the same as physical theft, but you should at least try to understand the point I'm trying to make.
Let's say that even if it is legal in whatever piece of land you're standing on, you'll get banned anyways because this forum has its own rules.

If the admin wants to forbid a word and ban whoever writes it with an auto-ban script, he can do it.

The admin here said: no warez, no copyrighted game downloading, and that's how it goes.
