What a shame, but perfectly understandable that Dolphin isn't willing to fight Nintendo on this.
I'm excited to see the big picture GUI!

Has there been any communication back to Valve to say you've checked with your legal counsel and they've confirmed Nintendo are chatting shit, so while you respect that it's Valve's storefront and they can reject Dolphin for any reason they feel like, but it would be really cool if they ignored Nintendo's request and let Dolphin onto Steam anyway? I don't think I've seen anything that indicates one way or the other whether the Valve people involved just assumed Nintendo were right and complied with the request to keep Valve in the clear, or whether it was a political decision to stay in Nintendo's good books even though they knew it was bunk.

Valve specifically went to Nintendo to ask if it was Ok. I doubt they would ask Nintendo and then proceed to ignore Nintendo demands. Valve already said their conditions, Dolphin said they won't pursue that path. End of the story.

That's the sticky part-my understanding of this whole situation is that there's nothing to fight Nintendo on. Valve is voluntarily denying access to their storefront-which they have the absolute right to do-conditioned on Nintendo's approval. There isn't even a tort claim here as it was Valve that initiated.

Scummy on Valve's part? Perhaps. Unfortunately, there's not much of anything that can be done about it.

I didn't know there were games that could use the extra resources of Dolphin! Does anyone have a list of the games that take advantage of the "Dolphin Mode" mentioned in the post?

Dolphin is on steam currently if you inject the core into steam version of retroarch. You get cloud saves and remote play together and it works as it should. i would just mention that the dolphin core is outdated but a good news piece would be updating the retroarch core and letting everyone know you technically can still use dolphin with steam features.

Which raises the question of why RetroArch is OK while Dolphin isn't.
