Poll: Develop code that could be considered as Nintendo's?
Yes, We need as close to a real Wii as possible.
No, If those features require code we didn't make, we shouldn't use them.
No, but if the Nintendo-developed code isn't essential...
Erm, Haven't we already done that to get most of the features we have?

Well, People are asking, and the developers could easily take them out...

The latest SVN adds two parts of the WiiConnect24 architecture, which could solve the online issues, finally...

However, they ARE more than likely copyright Nintendo.
The question, really, right now, is this...
Do the developers take them out, and declare WC24 as 'Only for the Wii'...
Or do they leave them in, and declare it 'fair use'?

if they are Nintendo copyright the dev's might not have any choice but to remove it rather than risking some sort of 'Disagreement' with Nintendo

To develop with the code, or make their own, that might not work...

if they develop with code that belongs to Nintendo then they might receive the dreaded cease and desist request from Nintendo
and unlike other emulators like PJ64 which can say that they are never going to make new games for the N64, Dolphin can run new releases which means that some people will rather than buy a wii use Dolphin and just buy the games alone which is something that Nintendo might not view favourably

Can't you dump your own wc24 binaries, like with the OS and LLE? Or are you saying the devs wrote code themselves, that is definitely similar to Nintendo's, and that files from your wii can't be used?

that's a bit of a grey area isn't it if you dump files from your own wii you should in theory be able to do what you want with them as long as your the only one using them but in Dolphin's case it is distributed to numerous people meaning that if the wc24 binaries are nintendo's or similar to them it is in a sense a form of piracy then because you don't own them but instead are making use of someone else's binaries but this would then mean that everyone would have to create their own Dolphin if they wanted to use dumped binaries which is pretty unlikely

:S Apparently depends on the type of file, the config files can't be copyrighted because ... idk, I think because that are preferences that we made so they can't say anything because that files are just a container for a bunch of settings that we set ( We already did that with the SYSCONF )

And if they are copyrighted then you should be able to dump that files from your own wii NAND dump

would that mean that if wc24 binaries where required for better online play then in order for them to be used every Dolphin user would have to have a wii and dump their own nands in order to avoid copyright issues with Nintendo

why does it seem that Dolphin is reaching a point in it's progress where it is becoming harder and harder for the devs to maintain it's balance on the fine line between legitimacy and piracy

Yyou're poll selections are extremely limited... and they don't touch the major issue at all... IF they ARE copyrighted... then posting them IS illegal, and they will have NO choice but to remove them. IF they are NOT copyrighted, then they should most definitely be included, as the primary goal of any emulator is to function as closely as possible to the real system, while providing additional features and options.

I assume these files are dumped FROM the Wii. So If that is the case AND they ARE copyrighted, then they can supply the tools and people can pull the files from the Wii that they OWN. Much like the NAND or the GC's coef bin/rom files. This would keep it both legal and usable.

It might be limited, and yes, if Nintendo were to pull out the banhammer, this recent revision would be toast, but, well, to be honest, many emulators would be toast if Nintendo, Sony, Sega and Microsoft got really antsy.

Really, Ever since the masterkey.bin file was no longer required, Dolphin has been on a fine line.
It doesn't require the NAND dump. It doesn't require any files off the Wii or Gamecube...
It's running Wii and Gamecube games off it's own code.

The only reason I brought this up is that WC24 binaries are a lot more than creating your own universal system software, Version 'whatever the game wants'.
Do we say 'Yes, We need this code'...
Or agree that Nintendo might just notice this commit more than the rest...
Well, One day, Dolphin might not even need the Wii Menu dump.
