TLDR: This is the definitive SMS texture pack, a collaboration between qashto and razius, that includes upscales and retextures for the whole game! Download the DDS BC7 version of this pack, which does not work with v5.0 of Dolphin, it requires the latest v5.x development build. Check "Enable Cheats" in the General settings of Dolphin. Check "Load Custom Textures" and "Prefetch Custom Textures" in the Advanced tab of the Graphics settings to prevent stuttering. I know a lot of you would probably pay $60 for a SMS HD remake from Nintendo, so if you really like this pack and appreciate the work I did, send me $60! ...any amount is good though I guess

If you're wondering what I'm talking about, have a look at this discussion on a recent matter. However, before I go on, I don't think your project has anything to worry about (explained more below) so before you start sweating, this has my seal of approval, no worries.

Anyway, what it boils down to is that we shouldn't have custom/HD textures that too closely resemble the source textures so that we can avoid infringing on copyrights (and NIntendo loves a good DMCA takedown). E.g. scaling filters do enhance an image, but they often follow the source material too closely, for example, keeping noise or compression artifacts, or edges that should otherwise be smoothed when upscaled. Situations like that makes the "new" texture only slightly distinguishable from the source, which in turn goes back to copyrights and that sort of trouble. So in essence, we're looking for custom/HD textures that are "transformative" enough.

But, as noted in the discussion I linked to, it's on a case-by-case basis that we look into these things. The ones you drew in GIMP are fine, no problems there (they look amazing btw especially that wanted poster). The blob textures made by waifu2x look fine to me as well (a lot of noise has been removed, and imo, looks like an artist redrew it rather than a neural network). The granite textures slightly concern me, if only that the differences aren't very apparent until you view the 512x512 vs 2048x2048 version. Again, it's impressive what waifu2x can do; it literally added texture/depth where there wasn't any in the source. So in short, I think waifu2x manages to be "transformative" for this texture pack since it adds artistic elements not present in the source. Other scaling methods (such as xBR) don't particularly do that, which is what we're concerned about, from a legal standpoint.

TL;DR - Looks good to me. Good job.

Thank you!  I agree many of the upscales by waifu2x do look as if they've been redrawn by an artist.  I will add the Hotel Delfino boo paintings to the comparisons page, they are good examples of the transformative nature of the upscaler as well.  After reading your post I am concerned about the Mario head textures that I cut from Super Mario Run Stickers (the iOS iMessage app).  Users of the app can legally distribute these images to other phones so I figured they were fair game.  The two textures I'm referring to are tex1_34x44_7220ef93ed86ab4e_5 and tex1_35x38_47d941afe5ba76d6_5.  The latter of which I actually drew in the bottom of Mario's ear since it is obstructed by Mario's shoulder in the original sticker.  Is this transformative enough?  The former I simply cut out Mario's head from his shoulders and edited his chin a little.  Should I remove either of these textures from the pack?

I'm assuming you didn't actually read a thing I wrote? Copyright is something we take very seriously around here, not because we like it, but because we have to. It's not like we could just ignore an angry letter from a lawyer, even if we really wanted to. Simply looking the other way is not how you run a community. At any rate, I'm not even saying a single texture needs to be removed from qashto's texture pack for fear of copyright infringement. I'm saying I see no problem whatsoever. I merely made the OP aware of some legal concerns that have happened in the past.

I think those textures should be fine. It sounds like the image could be shared as-is, so you wouldn't have to worry about it being transformative enough. I am not a lawyer (nor do I ever want to be one) but that's what it seems like on the surface. If you're super paranoid, you could remove them, but you're probably in the clear since anyone can send the images, and the images are technically freely/publicly available (through iOS and iMessage at least).
