While obviously Nintendo won't approve of the NUS downloader, its whole purpose is to aquire the files legally. Nintendo's own servers are willingly handing you the files over, even if they're being "tricked".

It's basically your PC telling the servers, "Hi I'm a wii, can I get the files?" and the server says "K, lol, here take them"
