For the first case I mentioned, only a small number of such games exist; you really have to look to find them. So yes, they're particularly rare The second case may be more common since DX9 has graphical issues with a number of games, and some people may find that OpenGL performs the worst on their system, but that depends on various factors (GPU, drivers, OS, etc).
