if you dont have a wii but have a legal wii rNINTENDO rom with update you can extract a System menu wad form it with dolphin's iso properties.

well, I have a Wii in real life, so how can I get the system menu data from it?

It's still illegal, you still need the key.bin (masterkey) which needs to be dumped from a real Wii, a Wii that you own else it is illegal. Also, once you sell your system you forfeit your rights to the bios, encryption keys etc.. since the person who bought your system now owns everything associated with the system.. Just like if you bought a game and sold it, you have forfeited your rights to a backup (archival) copy.

As far as I'm aware you may be able to download the system menu with NUS, but it isn't a 1:1 copy of the actual nand. That means no channels and if the system menu is ever fully functional you'll find out that system menu wad that you installed will be broken in more ways than one. My 1:1 nand dump was about 300 - 400+ MB uncompressed, compressed it was about 200 MB, the system menu wad is only about 20 MB so there is a lot missing.

I dumped my wii nand and followed the guide to use it with dolphin, but it only has the disc channel

Well they shouldn't include the key as it is illegal to do so. Now if the Dolphin team created their own key/implementation it would be legal, but the key would likely not be compatible with NUS Downloader if it's their own implementation as it wouldn't be recognized as a valid key by Nintendo. Redistributing copyrighted encryption/decryption keys are illegal for the same reason redistributing a PS2 bios is illegal, so I'd be surprised if the Dolphin team is redistributing an actual key in the source code.

I would guess the key is generated like in WiiScrubber?

The Wii scrubber Makecommonkey.exe is in the bare minimum of what you consider legal , they encrypted the key with the number 42 so we can decrypt it later. Apparently you can't redistribute them as the normal key
