No it wasn't. Available for preorder (like it was on wal-mart) is not the same thing as a sale of a physical copy

It's not like retailers can just take a new game like Black Ops,
start selling it 4 days earlier and reap massive profits over 'honest' stores without legal consequences..

Retailers sign a contract with the distributor on which date either a NDA (non-disclosure agreement) or a shipping restriction expires, and all retailers are allowed to publish whatever products they are authorized after that date.

These people are just making excuses for copyright infringement & the fact they are too cheap to pay for games and support the developers
