Taking people to courts is expensive and risky, so we'd rather not do that. The key point of the problem is that technically he's doing nothing illegal. The GPL explicitly allows him to distribute 4.0 builds on his website (... although he'd be required to distribute the source as well, but since he links to our source code it's not all that much of an *obvious* GPL violation). It's mainly a moral issue, but he doesn't seem to have any problems with that.

thx MaJoR. I remember that changing in domain. So he is playing the domain game and no we cant do crap about it except what the devs said.
Exactly. We actually tried to improve the situation by making Dolphin builds "detect" if builds were downloaded from that site and error out if they were. That worked fine for a few revisions but he noticed soon enough. End of the game was that he stopped doing nightly builds altogether, yielding the infamous "3.5-367" situation. Basically the only thing that he has done since then was uploading 4.0 (surprisingly enough, he didn't seem to copy our installer but compiled his own version of it).

That s*cker´s main and download pages are in the two first places, while the main and download official ones are in third and fourth places respectively (I am searching in Google right now).

Wait, that site has 4.0 now? *grabs pitchfork*

IIRC, GPL only covers sharing rights for code. We can still pin anyone for copyright infringement, thanks to MaJoR's icons (unless he CC'ed them already, he/the Dolphin team has the rights for distribution). Legal ammo? Maybe...

I think he doesn't do anything wrong. Somebody might disagree but this is only my perspective. No need to discuss about this. Also, it's not a fake site. It's a real website but it's not an official one. Actually, his website is pretty good and quite informative. I started using Dolphin from that website and eventually found this website because I searched for forums.

Is that in writing in the License.txt? Not too late to hit mamario with DMCA complaint. :p If we look hard enough, perhaps we can find a code modification (strings are enough) in the 4.0 mamario's providing.

For what it's worth, I tried to warn shuffle2 at the time about not letting random guys run and own the website, but he didn't see an issue with it and there really wasn't anyone else who wanted to do it. Other than that, just running a site and providing builds is not a crime. Unfortunately, he was freely handed the keys to a very popular project that had the potential for huge earnings. We're getting into the money aspect of this now. which was never a concern before.

Exactly. Providing binaries and also a link to the official website that hosts the source code doesn't violate the GPL.
