I have discovered that after installing the new driver there has been a change, when I now run the game with OpenGL it does constantly overclock the GPU a little (650Mhz of the possible 1150Mhz) and this clock rate would be good enough to play the games I want to play on minimum settings with 100% speed IF it was done under Direct3D9, however with OpenGL it is so that even though the GPU is clocked almost twice as high now the fps actually is lower.

Open Intel graphics media control panel (Control Panel - All CP items) -> 3D : set everything to max quality

This only seems to set the CPU Turbo Boost on, which was already working properly, however I have discovered the problem. I joined an Acer forum page which had just begun discussing this problem, it seems that on my system the CPU and GPU are prohibited from Properly Turbo Boosting at the same time and that the CPU gets priority, this is probably done for battery saving options and the manufacturer (Acer) left out an option to enable full Turbo Boost, it seems that Acer has noticed the desire for such an option and they say that they will look into it, whatever that will bring forth I don't know, but I hope they ad this option so that my system might operate optimally.
