Please forgive my ignorance but wouldn't making Dolphin available via "Side Quest" (https://sidequestvr.com/) not the Oculus store make the license issue a non issue?
The license issue we're talking about isn't about the Oculus Store, it's about the Oculus SDK. You need that SDK (or some kind of replacement SDK, but I'm not aware of one existing) in order to get a program running on the device, regardless of how you then distribute the program.

Certainly it would be nice to see something like that happen, but Dolphin is a volunteer-run project where people work on things they find interesting and perhaps not too hard. Personally, I both have a full-time job and am busy maintaining the regular Android port of Dolphin. Other people's situations may look a bit different, but there's nobody who both has ample free time available, the skills needed to pull this off, and the interest.
